Synopsis: Use of mobile telephone in motor vehicle. Prohibits the operation of a motor vehicle and the simultaneous operation of a mobile telephone. Provides an exception to the prohibition for the operator of an authorized emergency vehicle, medical services vehicle, or a privately owned vehicle when the operator or passenger is a volunteer firefighter or a certified emergency medical provider en route to the scene of a fire or other emergency in the line of duty, subject to certain conditions.

SENATE BILL No. 386



    A BILL FOR AN ACT to amend the Indiana Code concerning motor vehicles.

Be it enacted by the General Assembly of the State of Indiana:

    SECTION 1. IC 9-13-2-103.3 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2000]: Sec. 103.3. "Mobile telephone" means a commercial mobile radio service (CMRS) (as defined in IC 36-8-16.5-5 ) telephone.
    SECTION 2. IC 9-21-8-52.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2000]: Sec. 52.5. (a) A person may not operate a motor vehicle and simultaneously operate a mobile telephone (as defined in IC 9-13-2-103.3 ).
     (b) Subsection (a) does not apply to an operator of:
        (1) an authorized emergency vehicle;

         (2) a medical services vehicle;
        (3) a privately owned vehicle when the operator or passenger is a volunteer firefighter en route to the scene of a fire or other emergency in the line of duty, subject to IC 36-8-12-11 ; or


        (4) a privately owned vehicle when the operator or passenger is a certified emergency medical provider en route to the scene of emergency medical services activities in the line of duty, subject to IC 9-19-14.5-1.
