Provides that an employee of the state or a political subdivision is entitled to paid leave to serve as a precinct election officer or to work for a candidate or a candidate's committee on election day.

    A BILL FOR AN ACT to amend the Indiana Code concerning state and local government.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 1-1-9-1; (00)IN1291.1.1. -->     SECTION 1. IC 1-1-9-1 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 1. (a) The following are legal holidays within the state of Indiana for all purposes:
        New Year's Day, January 1.
        Martin Luther King, Jr.'s Birthday, the third Monday in January.
        Abraham Lincoln's Birthday, February 12.
        George Washington's Birthday, the third Monday in February.
        Good Friday, a movable feast day.
        Memorial Day, the last Monday in May.
        Independence Day, July 4.
        Labor Day, the first Monday in September.
        Columbus Day, the second Monday in October.
        Election Day, the day of any general, municipal, or primary election.
        Veterans Day, November 11.
        Thanksgiving Day, the fourth Thursday in November.
        Christmas Day, December 25.
        Sunday, the first day of the week.
    (b) When any of these holidays, other than Sunday, comes on Sunday, the following Monday shall be the legal holiday. When any of these holidays comes on Saturday, the preceding Friday shall be the legal holiday.
    (c) The provisions of this section shall not affect any action taken by the general assembly while in session, and any action taken by the general assembly on any such holiday shall be valid for all purposes.
SOURCE: IC 1-1-9-3; (00)IN1291.1.2. -->     SECTION 2. IC 1-1-9-3 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 3. (a) The definitions in IC 3-5-2 apply throughout this section.
    (b) As used in this section, "employee" refers to an employee of any of the following:
        (1) The legislative, executive, or judicial branch of state government.
        (2) A political subdivision (as defined in IC 36-1-2-13 ).
    (c) Subject to subsection (d), an employee who does either of the following is entitled to paid leave from the employee's government job on election day:
        (1) Serves as a precinct election officer.
        (2) Works for a candidate or a candidate's committee.
    (d) An employee who wants to qualify for paid leave under subsection (c) may be required to document the employee's activities on election day under reasonable written guidelines established by the employee's government employer.
