Synopsis: Court employee political activity. Provides that a court employee (other than a judge or a justice) may not be denied the right to engage or refuse to engage in political activity except when on duty, acting in an official capacity, or as otherwise provided by Indiana statute or federal law. This proposed amendment has not been previously agreed to by a general assembly.

Effective: This proposed amendment must be agreed to by two consecutive general assemblies and ratified by a majority of the state's voters voting on the question to be effective.

    A JOINT RESOLUTION proposing an amendment to Article 7 of the Constitution of the State of Indiana concerning courts and court officers.

Be it resolved by the General Assembly of the State of Indiana:

SOURCE: ; (00)HJ9207.1. -->     SECTION 1. The following amendment to the Constitution of the State of Indiana is proposed and agreed to by this, the One Hundred Eleventh General Assembly of the State of Indiana, and is referred to the next General Assembly for reconsideration and agreement.
SOURCE: CON 7; (00)HJ9207.2. -->     SECTION 2. ARTICLE 7 OF THE CONSTITUTION OF THE STATE OF INDIANA IS AMENDED BY ADDING A NEW SECTION TO READ AS FOLLOWS: Section 22. (a) This section does not apply to a judge or a justice.
    (b) A court employee, except when on duty, acting in an official capacity, or as otherwise provided by Indiana statute or federal law, may not be:
        (1) prohibited from engaging in political activity; or
        (2) denied the right to refrain from engaging in political

activity.
