  | DIGEST OF INTRODUCED BILL Sex offenses and minors. Raises the penalty for possession of child pornography from a Class A misdemeanor to a Class D felony. Provides that child pornography applies to certain material that depicts or describes the sexual conduct of a child who is less than 18 years of age. (Under current law child pornography applies to certain material that depicts or describes the sexual conduct of a child who is less than 16 years of age.) Makes it a Class D felony for a person to knowingly or intentionally: (1) permit oneself to be depicted as a minor participating in certain sexual conduct or an exploitative exhibition; or (2) disseminate, receive, or display in various ways a visual depiction that depicts a participant as a minor engaging in sexual conduct or an exploitative exhibition. Provides that it is not a defense that the person depicted or the participant in the sexual conduct or exploitative exhibition is an adult. Expands the definition of sexual matter. |
