  | DIGEST OF INTRODUCED BILL Elective or judicial vacancies caused by death. Provides that any person who knows of the death of an elective or judicial officer may notify: (1) the secretary of state, in the case of a state elective or judicial officer; or (2) the circuit court clerk of the county in which the elective or judicial officer resided, in the case of a local elective or judicial officer. Requires the secretary of state or the circuit court clerk to give notice of the death to the person or governmental body that has the power to fill the vacancy or to call a caucus or meeting to fill the vacancy caused by the death. In all procedures to fill a vacancy caused by the death of a state or local elective or judicial officer, prohibits the person or governmental body that has the power to fill the vacancy, or to call a caucus or meeting to fill the vacancy, from acting until that person or governmental body has received notice of the death from the secretary of state or the circuit court clerk. Changes the date for holding a meeting or caucus to fill a vacancy resulting from death from not later than 30 days after the vacancy occurs to not later than 30 days after the person calling the meeting or caucus receives notice of the death from the secretary of state or the circuit court clerk. Makes conforming amendments. |
