COMMITTEE REPORT

    Mr. Speaker: Pursuant to Joint Rule 20, your Committee on Rules and Legislative Procedures, to which was referred Engrossed House Bill 1855 because it conflicts with HEA 1892- 2001 without properly recognizing the existence of HEA 1892-2001, has had Engrossed House Bill 1855 under consideration and begs leave to report back to the House with the recommendation that Engrossed House Bill 1855 be corrected as follows:


    Page 6, line 10, delete "P.L.14-2000," and insert "HEA 1892- 2001, SECTION 17,".
    Page 6, line 11, delete "SECTION 76,".
    Page 7, line 17, after "in" insert "or manufacturing".
    Page 7, line 17, delete "or" and insert ",".
    Page 7, line 17, after "drug" insert ", or methamphetamine".
    Page 7, line 26, delete "P.L.188-1999," and insert "HEA 1892-2001, SECTION 30,".
    Page 7, line 27, delete "SECTION 8,".
    Page 8, delete lines 31 through 35, begin a new line double block indented and insert:
            "(O) dealing in cocaine, a narcotic drug, or methamphetamine (IC 35-48-4-1) if the court finds the person possessed a firearm (as defined in IC 35-47-1-5) at the time of the offense, or the person delivered or intended to deliver to a person under eighteen (18) years of age at least three (3) years junior to the person and was on a school bus or within one thousand (1,000) feet of:
                (i) school property;
                (ii) a public park;


                (iii) a family housing complex; or
                (iv) a youth program center;
            (P) dealing in a schedule I, II, or III controlled substance (IC 35-48-4-2) if the court finds the person possessed a firearm (as defined in IC 35-47-1-5) at the time of the offense, or the person delivered or intended to deliver to a person under eighteen (18) years of age at least three (3) years junior to the person and was on a school bus or within one thousand (1,000) feet of:
                (i) school property;
                (ii) a public park;
                (iii) a family housing complex; or
                (iv) a youth program center;".
