Synopsis: Insurer and health care provider contracting. Defines "all services contract" for purposes of accident and sickness insurer and health maintenance organization provider contracts. Prohibits accident and sickness insurers and health maintenance organizations from entering into an all services contract with a provider.

    A BILL FOR AN ACT to amend the Indiana Code concerning insurance.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 27-8-11-7; (01)IN1461.1.1. -->     SECTION 1. IC 27-8-11-7 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2001]: Sec. 7. (a) As used in this section, "all services contract" means a contract between an accident and sickness insurer and a provider that requires the provider to provide health care services under all plans, policies, or contracts of coverage issued, entered into, or delivered by the accident and sickness insurer.
    (b) As used in this section, "accident and sickness insurer" means an insurer (as defined in IC 27-1-2-3(x)) that provides coverage under a policy covering one (1) or more of the types of insurance described in Class 1(b) and 2(a) of IC 27-1-5-1.
    (c) An accident and sickness insurer may not enter into an all services contract with a provider. All services contracts are against the public policy of this state.

services contract" means a contract between a health maintenance organization and a provider that requires the provider to provide health care services under all plans, policies, or contracts of coverage issued, entered into, or delivered by the health maintenance organization.
    (b) A health maintenance organization may not enter into an all services contract with a provider. All services contracts are against the public policy of this state.
