    A BILL FOR AN ACT to amend the Indiana Code concerning criminal law and procedure.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 5-2-5-2; (01)IN2066.1.1. -->     SECTION 1. IC 5-2-5-2 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2001]: Sec. 2. (a) The department shall act as the official state central repository for:
         (1) uniform crime reports; and
         (2) criminal history data.
     (b) Any sheriff, police department, or criminal justice agency within the state of Indiana shall report to the department, on forms provided by the department, all arrests for reportable offenses.
SOURCE: IC 5-2-5-2.3; (01)IN2066.1.2. -->     SECTION 2. IC 5-2-5-2.3 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2001]: Sec. 2.3. (a) The department shall establish a format and system for each law enforcement agency to use in making uniform crime reports to the department.
    (b) The department shall give each law enforcement agency sufficient technical assistance to implement a program to comply with section 2.4 of this chapter. The department shall annually report to the executive director of the legislative services agency

the name of any law enforcement agency that is not in compliance with section 2.4 of this chapter.

SOURCE: IC 5-2-5-2.4; (01)IN2066.1.3. -->     SECTION 3. IC 5-2-5-2.4 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2001]: Sec. 2.4. Each law enforcement agency shall make uniform crime reports to the department in the form and on the schedule specified by the department.
SOURCE: IC 5-2-5-2.5; (01)IN2066.1.4. -->     SECTION 4. IC 5-2-5-2.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2001]: Sec. 2.5. The department shall maintain uniform crime report information in the form and according to the standards established by the Federal Bureau of Investigation. The department shall submit uniform crime report information to the Federal Bureau of Investigation in the form and on the schedule established by the Federal Bureau of Investigation.

[EFFECTIVE JULY 1, 2001] (a) The state police department may exempt one (1) or more law enforcement agencies from compliance with IC 5-2-5-2.4 , as added by this act, for not later than December 31, 2002. In determining whether to exempt a law enforcement agency under this SECTION, the state police department shall consider at least the following:
        (1) The availability of the format and system for crime reports required under IC 5-2-5-2.3 , as added by this act.
        (2) Whether sufficient training has been made available to enable the law enforcement agency to adequately comply with IC 5-2-5-2.4 , as added by this act.
        (3) Whether the law enforcement agency has adequate procedures, personnel, and equipment in place to comply with IC 5-2-5-2.4 , as added by this act.
    (b) This SECTION expires January 1, 2003.
