Synopsis: Specifies that a special group qualified for participation in the special group recognition license plate program must be organized as a nonprofit organization. Authorizes the bureau of motor vehicles to adopt rules to establish requirements for participation in the special group recognition license plate program. Specifies that if the bureau determines that a special group meets the requirements for participation, the bureau shall issue the special group a special group recognition license plate. Requires a special group approved for participation in the program after December 31, 2001, to submit a bond. Requires payment of the bond if less than 500 of the special group's license plates are sold in the first year that they are available. Provides that the representatives of a special group participating in the special group recognition license plate program are solely responsible for the marketing of the special group's special group recognition license plate.

    A BILL FOR AN ACT to amend the Indiana Code concerning motor vehicles.

Be it enacted by the General Assembly of the State of Indiana:

    SECTION 1. IC 9-13-2-170 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JANUARY 1, 2002]: Sec. 170. "Special group" means a class or group of persons that the bureau finds:
         (1) that:
            (1) (A) have made significant contributions to the United States, Indiana, or the group's community; or
            (2) (B) are descendants of native or pioneer residents of Indiana;
        (2) are organized as a nonprofit organization;
        (3) are organized for nonrecreational purposes; and
        (4) are organized as a separate, unique organization or as a coalition of separate, unique organizations.

    SECTION 2. IC 9-18-25-2 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JANUARY 1, 2002]: Sec. 2. (a) The bureau shall adopt rules under IC 4-22-2 establishing the requirements to qualify for participation in the special group recognition license plate program.


    (b) Representatives of a special group may petition the bureau to qualify for participation in the special group recognition license plate program.
    (c) Each petition submitted under this section must contain the signatures of at least five hundred (500) members of the special group who pledge to purchase the special group recognition license plate if a special group recognition license plate is issued for the group under this chapter.
    (d) If the bureau determines that a special group meets the requirements for participation in the special group recognition license plate program under the bureau's rules,
the bureau shall design and issue a special group recognition license plate that designates a vehicle as being registered under this chapter by a person (as defined in IC 9-13-2-124) who is a member of a the special group. if:
        (1) a special group recognition license plate is required by statute;
        (2) a special group recognition license plate is requested by resolution of the general assembly; or
        (3) representatives of a special group petition the bureau.
    SECTION 3. IC 9-18-25-5 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JANUARY 1, 2002]: Sec. 5. The bureau may require representatives of a special group to do the following:
        (1) confer Confer with the bureau concerning the design of the emblem that identifies the vehicle as being registered to a person who is a member of a special group . and
        (2) provide Provide the bureau with a list of the names and addresses of the persons who are:
            (A) members of the special group; and
            (B) eligible for a special group recognition license plate.
         (3) Provide the financial commitment required under section 5.5 of this chapter to pay the bureau's expenses incurred for plate design and display.
    SECTION 4. IC 9-18-25-5.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JANUARY 1, 2002]: Sec. 5.5. (a) This section applies to a petition for participation in the special group recognition license plate program approved after December 31, 2001.
    (b) If the bureau approves a petition for participation in the special group recognition license plate program,
the representatives of the special group must submit a bond issued by a surety company or a cash bond in the amount of six thousand dollars ($6,000) before the bureau orders the special group's

special group recognition license plates.
    (c) If less than five hundred (500) of the special group's special group recognition license plate are sold in the first year in which the license plate is available, the bond must be conditioned for payment to the bureau of the amount determined under STEP THREE of the following formula:
        STEP ONE: Determine the number of the special group's special group recognition license plates sold during the year.
        STEP TWO: Subtract the STEP ONE result from five hundred (500).
        STEP THREE: Multiply the STEP TWO result by twelve dollars ($12).
    (d) Once five hundred (500) of the special group's special group recognition license plate are sold in the first year in which the license plate is available, the bureau shall return the bond to the representatives of the special group.
    (e) A bond submitted under this section may not be canceled unless the bureau receives notice of the pending cancellation at least ten (10) days before the cancellation of the bond.

     (f) This section may not be construed to relieve a special group from the minimum sales requirements set forth in section 15 of this chapter.
    SECTION 5. IC 9-18-25-18 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JANUARY 1, 2002]: Sec. 18. The representatives of a special group participating in the special group recognition license plate program are solely responsible for the marketing of the special group's special group recognition license plate.
    SECTION 6. THE FOLLOWING ARE REPEALED [EFFECTIVE JANUARY 1, 2002]: IC 9-18-25-4; IC 9-18-25-6.
