Synopsis: Disposal of coal combustion wastes. Requires the natural resources commission to adopt rules to regulate the disposal of coal combustion wastes in surface coal mines that contain requirements at least as stringent as those that apply to the disposal of coal combustion wastes in solid waste landfills.

SENATE BILL No. 72



    A BILL FOR AN ACT to amend the Indiana Code concerning natural and cultural resources.

Be it enacted by the General Assembly of the State of Indiana:

    SECTION 1. IC 14-34-2-1 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2002]: Sec. 1. The commission shall do the following:
        (1) Adopt rules under IC 4-22-2 that do the following:
            (A) Effectuate the purposes of this article.
            (B) Take into account the following:
                (i) The terrain, climate, biologic, chemical, and other physical conditions in those areas of Indiana where surface coal mining operations may occur.
                (ii) Land use considerations of the state and the state's political subdivisions.
             (C) Establish requirements that:
                (i) regulate the disposal of coal combustion wastes in surface coal mines;
                (ii) protect human health and the environment; and
                (iii) are at least as stringent as the requirements that apply to the disposal of coal combustion wastes in solid

waste landfills (as defined in IC 13-11-2-208 ) regulated under IC 13.
        (2) Perform all other duties required under this article.
    SECTION 2. [EFFECTIVE JULY 1, 2002] (a) The natural resources commission shall adopt the rules required under IC 14-34-2-1 (1)(C), as added by this act, before July 1, 2003.
    (b) This SECTION expires July 2, 2003.
