    A BILL FOR AN ACT to amend the Indiana Code concerning health.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 20-8.1-7-23; (02)IN1337.1.1. -->     SECTION 1. IC 20-8.1-7-23 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS [EFFECTIVE JULY 1, 2002]: Sec. 23. (a) After December 31, 2002, the governing body of a school corporation shall administer an asthma screening program according to rules adopted under subsection (c) for children enrolled in the first grade and other children suspected of having asthma.
    (b) Records of asthma screenings conducted under subsection (a) must be maintained and forwarded annually to the state department of health and the Indiana state board of education for purposes of improving the health of school children.
    (c) The state department of health and the Indiana state board of education shall adopt joint rules under IC 4-22-2 establishing an asthma screening program for children enrolled in the first grade and other children suspected of having asthma. The rules must include:
        (1) requirements for asthma screening equipment;
        (2) qualifications of asthma screening personnel;
        (3) asthma screening procedures; and
        (4) criteria for failure of the screening tests and referral standards based upon accepted medical practice and standards.
