Requires the commission to submit before July 1, 2003, a report to the governor with the results of the evaluation and investigation and the commission's recommendations.

    A BILL FOR AN ACT concerning education.

Be it enacted by the General Assembly of the State of Indiana:

    SECTION 1. [EFFECTIVE UPON PASSAGE] (a) As used in this SECTION, "commission" refers to the commission established by subsection (c).
    (b) As used in this SECTION, "IUPUI" refers to the regional campuses of Indiana University and Purdue University located in Indianapolis, Indiana. However, the term does not include the following:
        (1) Indiana University School of Medicine.
        (2) Indiana University School of Dentistry.
        (3) Indiana University School of Nursing.
        (4) Indiana University School of Law-Indianapolis.
    (c) The commission for evaluating the establishment of an independent, state supported university in Indianapolis is established.
    (d) Before July 15, 2002, the governor shall appoint nine (9) individuals who are citizens of the United States and residents of Indiana to serve on the commission. Of the nine (9) members, at least:


        (1) one (1) member must be an alumnus of IUPUI;
        (2) one (1) member must be a full-time student at IUPUI; and
        (3) two (2) members must be residents of Marion County.
    (e) Before July 15, 2002, the governor shall appoint the initial chairperson of the commission, who serves until the commission submits the report required under subsection (l). If the commission recommends in its report that a separate, independent, state supported university be established to succeed IUPUI, the governor shall immediately appoint a chairperson of the commission to serve until July 1, 2005.
    (f) If a member of the commission resigns from the commission or the governor determines that a member of the commission is unable to perform the member's duties under this SECTION, the governor may appoint an individual to replace the member.
    (g) Each member of the commission who is not a state employee is not entitled to the minimum salary per diem provided by IC 4-10-11-2.1 (b). The member is, however, entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties as provided in the state policies and procedures established by the Indiana department of administration and approved by the budget agency.
    (h) Each member of the commission who is a state employee but who is not a member of the general assembly is entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties as provided in the state policies and procedures established by the Indiana department of administration and approved by the budget agency.
    (i) Each member of the commission who is a member of the general assembly is entitled to receive the same per diem, mileage, and travel allowances paid to members of the general assembly serving on interim study committees established by the legislative council.
    (j) The commission shall investigate and evaluate the following:
        (1) All aspects of the delivery of higher education at IUPUI.
        (2) The feasibility of establishing an independent, state supported university to succeed IUPUI.
        (3) The benefits of eliminating the cooperative presence at IUPUI of Indiana University and Purdue University to strengthen the individual aspects of the two (2) universities.
    (k) In carrying out the commission's duties, the commission

shall consult with and receive testimony from alumni, faculty, and students of IUPUI, residents of Marion County, and any other individuals who want to offer testimony concerning the future of IUPUI.
    (l) Before July 1, 2003, the commission shall submit a report to the governor, the legislative council, and the executive director of the legislative services agency that recommends the following:
        (1) Whether an independent, state supported university should be established to succeed IUPUI.
        (2) Other changes that will benefit the delivery of higher education at IUPUI.
        (3) That, if an independent university is established to succeed IUPUI, the university be named the "University of Central Indiana".
    (m) The administration of IUPUI shall furnish the administrative support and staff necessary for the effective operation of the commission.
    (n) This SECTION expires July 1, 2005.

    SECTION 2. An emergency is declared for this act.
