Synopsis: Premiums for Medicaid buy-in program. Specifies that the
office of Medicaid policy and planning's (office) calculation of an
individual's personal needs allowance includes income in addition to
federal Supplemental Security Income. Requires the office to adjust, at
additional times to the annual review, the premium for working
disabled persons to participate in the Medicaid buy-in program.
Requires the office to adjust the premium upon verification of a change
in the person's income or family size.
Effective: July 1, 2003.

A BILL FOR AN ACT to amend the Indiana Code concerning
Medicaid.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1.

JULY 1, 2003]: Sec. 6. (a) If an individual described in section 1 of this
chapter:
(1) is a recipient of assistance under the federal Supplemental
Security Income (SSI) program; and
(2) receives an income that is less than the amount described in
section 2 of this chapter;
the office shall pay to the individual an amount equal to the difference
between the amount of the monthly allowance described in section 2 of
this chapter and the amount of income, including assistance under the
federal Supplemental Security Income (SSI) program received by the
individual.
(b) Money paid to an individual under subsection (a) is exempt from
income eligibility consideration.

Security Income (SSI) program; and
(2) receives an income that is less than the amount described in
section 6 of this chapter;
the office shall pay to the individual an amount equal to the difference
between the amount of the monthly personal allowance described in
section 6 of this chapter and the amount of income, including
assistance under the federal Supplemental Security Income (SSI)
program received by the individual.
(b) Money paid to an individual under subsection (a) is exempt from

JULY 1, 2003]: Sec. 9. (a) The office shall annually review the amount
of the premium that an individual is required to pay under section 8 of
this chapter.
(b) The office may increase the premium required under section 8
of this chapter only after conducting an annual review under subsection
(a).
(c) (b) In addition to the annual review required under
subsection (a), the office shall
decrease adjust the premium that an
individual is required to pay under section 8 of this chapter if:
(1)
a change in the
individual notifies the office of a change in
individual's income or family size
is verified; and
(2) the sliding scale adopted under section 7 of this chapter
applied to the individual's changed circumstances prescribes a
premium for the individual that is
lower than different from the
premium the individual is paying.
