MR. SPEAKER:

    Your Committee on       Public Health     , to which was referred       House Bill 1540     , has had the same under consideration and begs leave to report the same back to the House with the recommendation that said bill be amended as follows:

SOURCE: Page 5, line 2; (03)CR154001.5. -->     Page 5, line 2, delete "statistic records" and insert " records, vital reports, and vital statistics".
    Page 5, line 32, delete "," and insert ":
        (1) a vital record that is a certificate or report of a death shall be made available for inspection and copying fifty (50) years after the creation of the record; and
        (2)
".
    Page 8, line 20, after "report." insert " However, information that may identify a person named in a vital record or report may be released to:
        (1) a person doing a genealogical study; or
        (2) a person acting as a representative of the news media (as defined in IC 5-14-1.5-2 (j));
in compliance with rules adopted by the state department under IC 4-22.
".

    Page 10, between lines 25 and 26, begin a new line block indented and insert:
        " (7) When:
            (A) a person conducting a genealogical study;

            (B) a person acting as a representative of the news media (as defined in IC 5-14-1.5-2 (j));
        in compliance with a rule adopted by the state department under IC 4-22 proves a documented need for the death certificate.
".
    Page 11, line 2, delete "through fraud or" and insert " with false or inaccurate information, the state registrar shall withhold issuance of any copy of the certificate pending an investigation by the state registrar. If, upon conclusion of the investigation, false or inaccurate information is not found, copies may be issued. If, upon conclusion of the investigation, false or inaccurate information is found, the state registrar shall remove the certificate from the file until the information is corrected or refer the matter to the appropriate law enforcement authorities if criminal activity is suspected. Upon referral to law enforcement authorities the certificate, evidence, and information gathered by the state registrar".
