    A BILL FOR AN ACT to amend the Indiana Code concerning education and to make an appropriation.

Be it enacted by the General Assembly of the State of Indiana:

    SECTION 1. IC 20-5-65 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2003]:
    Chapter 65. Grants for Community Learning Programs
    Sec. 1. As used in this chapter, "board" refers to the Indiana state board of education established by IC 20-1-1-1.
    Sec. 2. As used in this chapter, "community learning program" means a program of educational opportunities for adults residing within the boundaries of a school corporation.
    Sec. 3. As used in this chapter, "qualifying school corporation" means a school corporation that has been approved by the board to receive a grant under this chapter.
    Sec. 4. The board shall establish:
        (1) an application form for grants for community learning programs; and
        (2) criteria for approval of a grant application for a community learning program.


    Sec. 5. To obtain a grant for a community learning program provided at a school in the school corporation, a school corporation must submit an application to the board.
    Sec. 6. (a) The board shall review applications submitted under section 5 of this chapter and approve applications that meet the criteria established under section 4 of this chapter.
    (b) In deciding which applications to approve under subsection (a), the board shall give preference to community learning programs that include:
        (1) adult literacy programs;
        (2) distance learning;
        (3) health seminars; or
        (4) health screenings.
    (c) Approval of applications under subsection (a) is subject to availability of funds.
    Sec. 7. The department of education shall award grants to school corporations whose applications are approved under section 6 of this chapter.
    Sec. 8. A grant under this chapter shall be made to a qualifying school corporation for a period of one (1) school year.
    Sec. 9. Not later than July 31 following a school year for which a grant is made under this chapter, the qualifying school corporation shall report to the department of education the number of adults who enrolled in the community learning program during the year for which the grant was made and any other information concerning the community learning program that the department of education requires by rule adopted under section 10 of this chapter.
    Sec. 10. The department of education shall adopt rules under IC 4-22-2 to implement this chapter.

    SECTION 2. [EFFECTIVE JULY 1, 2003] (a) There is appropriated to the department of education five million dollars ($5,000,000) from the state general fund for its use in carrying out the purposes of IC 20-5-65 , as added by this act, for the period beginning July 1, 2003, and ending June 30, 2005.
    (b) This SECTION expires July 1, 2005.
