MR. SPEAKER:

    I move that Engrossed Senate Bill 1 be amended to read as follows:

SOURCE: Page 5, line 17; (04)MO000170.5. -->     Page 5, delete lines 17 through 23, begin a new paragraph and insert:
    " (e) If:
        (1) either:
            (A) the department determines that a county's reassessment officials are unable to complete the reassessment in a timely manner; or
            (B) the department determines that a county's reassessment officials are likely to complete the reassessment in an inaccurate manner; and
        (2) the governor issues an executive order that directs the department to conduct a state conducted reassessment in the county under subsection (g);
".
    Page 5, line 35, after "law." insert " The department may consider an adjustment to be inaccurate if the county's reassessment officials do not perform the adjustment as prescribed by the department.".
    Page 5, line 36, delete "department" and insert " governor".
    Page 6, delete lines 5 through 12, begin a new paragraph and insert:
    " (g) Before assuming the duties of a county's reassessment officials, the department shall conduct a hearing in the affected county on the issue not earlier than ten (10) days after the department has published a notice of the hearing by publication one (1) time in each of two (2) newspapers of general circulation

that:
        (1) represent different political parties; and
        (2) are published in the county in which the property that may be reassessed is located.
However, if two (2) such newspapers are not published in the county, publication of the notice in one (1) newspaper of general circulation published in the county is sufficient. The department shall summarize the oral and written testimony presented at the hearing and present the summary along with the department's written responses to the governor for the governor's consideration. After receiving the written summary and comments, the governor may issue an executive order directing the department to conduct a state conducted reassessment in the county.
".
