A BILL FOR AN ACT to amend the Indiana Code concerning
courts and court officers.
SECTION 1. IC 33-4-1-60 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2004]: Sec. 60. (a) The county of
Owen shall be and constitute the seventy-eighth judicial circuit of the
state of Indiana.
(b) The Owen circuit court has a standard small claims and misdemeanor division.
(c) The judge of the Owen circuit court may appoint one (1) full-time magistrate under IC 33-4-7 to serve the court. The magistrate continues in office until removed by the judge. Funds may not be used to compensate both:
(1) a magistrate appointed by the court under this subsection; and
(2) a referee appointed by the court under the Indiana Rules of Court.
SECTION 2. [EFFECTIVE JULY 1, 2004] If a court appoints a magistrate under IC 33-4-1-60(c), as added by this act, the magistrate replaces any referee appointed by the court under
Small Claims Rule 14 of the Indiana Rules of Court.
