A BILL FOR AN ACT to amend the Indiana Code concerning
agriculture and animals.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 15-4-15 IS ADDED TO THE INDIANA CODE AS
CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY
Chapter 15. Biodiesel Fuel
Sec. 1. As used in this chapter, "biodiesel" has the meaning set
forth in IC 6-3.1-27-1.
Sec. 2. Except as otherwise provided in this section, all diesel
fuel sold or offered for sale in Indiana must contain by volume at
least two percent (2%) biodiesel (B2 or greater) by the later of the
(1) Not more than thirty (30) days after the commissioner of
agriculture determines that the annual capacity in Indiana for
the production of biodiesel exceeds twelve million (12,000,000)
(2) January 1, 2006.
Sec. 3. The requirement set forth in section 2 of this chapter
does not apply to diesel fuel used in the following:
(1) Railroad locomotives.
(2) Off-road mining equipment and machinery.
Sec. 4. The commissioner of agriculture shall publish notice on
accessIndiana (as defined in IC 5-21-1-1.5) when the condition set
forth in section 2 of this chapter is satisfied.
