SENATE MOTION


MADAM PRESIDENT:

    I move that Senate Bill 1005 be amended to read as follows:

SOURCE: Page 1, line 9; (04)MO100509.1. -->     Page 1, line 9, after "individual" insert " who is not an attorney".
    Page 2, between lines 40 and 41, begin a new line blocked left and insert:
" A closing agent is not liable for any other damages claimed by a customer because of the closing agent's mere failure to provide the appropriate document to the customer.".
    Page 4, line 18, delete "2006;" and insert " 2007;".
    Page 4, line 22, delete "2006;" and insert " 2007;".
    Page 4, line 24, delete "2005." and insert " 2006.".
    Page 5, line 41, after "claim" insert " approved by the department of local government finance and".
    Page 6, between lines 29 and 30, begin a new paragraph and insert:
SOURCE: IC 34-30-2-16.6; (04)MO100509.8. -->     "SECTION 8. IC 34-30-2-16.6 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2004]: Sec. 16.6. IC 6-1.1-12-43 (Concerning a closing agent's failure to provide a form concerning property tax benefits).".
    Renumber all SECTIONS consecutively.
