SENATE RESOLUTION



MADAM PRESIDENT:

    I offer the following resolution and move its adoption:

    A SENATE RESOLUTION urging the legislative council to direct the pension management oversight commission to examine and make recommendations regarding benefits for public safety officers who develop cancer or a heart condition that is related to their duties.

    Whereas, The 1925 police pension fund, the 1937 firefighters' pension fund, the 1953 police pension fund, and the 1977 police officers' and firefighters' pension and disability fund (collectively, the "fund") provide benefits for police officers and firefighters who are physically or mentally disabled and unable to perform the essential functions of their jobs;

    Whereas, A fund member may develop a disabling cancer or heart condition while the member is in the service of the police or fire department that may be caused by:
        (1) exposure to heat, radiation, or a known or suspected carcinogen; or
        (2) the physical stresses of the member's duties;
that may not be adequately compensated under the current benefit structure of the fund;

    Whereas, The options involved in making changes in the fund benefit structure to take into account these disabling conditions deserve study; and

    Whereas, The financial impact and funding sources of any changes proposed is unknown: Therefore,



Be it resolved by the Senate of the

General Assembly of the State of Indiana:


    SECTION 1. That the legislative council is urged to direct the pension management oversight commission to examine and make recommendations regarding benefits for public safety officers who develop cancer or a heart condition that is related to their duties.
    SECTION 2. That the commission, if so charged, shall operate under the direction of the legislative council and issue a final report when directed to do so by the council.
