    A BILL FOR AN ACT to amend the Indiana Code concerning state offices and administration.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 4-12-4.5; (05)IN0404.1.1. -->     SECTION 1. IC 4-12-4.5 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2005]:
    Chapter 4.5. Private Employer Health Insurance Program
    Sec. 1. As used in this chapter, "budget agency" refers to the budget agency created by IC 4-12-1-3(a).
    Sec. 2. As used in this chapter, "budget committee" refers to the budget committee established by IC 4-12-1-3(b).
    Sec. 3. The budget agency shall, not later than July 1, 2006, establish and implement a program through which a private employer:
        (1) with less than one hundred (100) employees; or
        (2) established in Indiana within the twelve (12) months immediately preceding the date the private employer applies for participation in the program;
may provide coverage for health care services (as defined in IC 27-8-11-1) for the employer's employees.
    Sec. 4. The program established under section 3 of this chapter may provide for the coverage through a group:
        (1) policy of accident and sickness insurance (as defined in IC 27-8-5-1);
        (2) contract with a health maintenance organization (as defined in IC 27-13-1-19); or
        (3) self-insurance program that meets solvency, coverage, and any other appropriate requirements that apply to the self-insurance program established to provide health coverage for state employees under IC 5-10-8-7(b).
    Sec. 5. (a) The budget agency shall, not later than December 31, 2005, and June 30, 2006, report to the budget committee concerning the status and structure of the program established under section 3 of this chapter.
    (b) This section expires July 1, 2006.
