Synopsis: Parental liability for judgments and fines. Provides that a
parent is liable for the payment of not more than $5,000 of a judgment
or fine imposed on the parent's child for violating an ordinance or
committing an infraction or a misdemeanor if: (1) the parent has
custody of the child; and (2) the child is living with the parent.
Effective: July 1, 2005.

A BILL FOR AN ACT to amend the Indiana Code concerning civil
procedure.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 34-31-4.5 IS ADDED TO THE INDIANA CODE
AS A
NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
JULY 1, 2005]:
Chapter 4.5. Limited Liability of Parents for Judgments or
Fines Owed by a Child
Sec. 1. A parent is liable for the payment of not more than five
thousand dollars ($5,000) of a judgment or fine imposed on the
parent's child for violating an ordinance or committing an
infraction or a misdemeanor if:
(1) the parent has custody of the child; and
(2) the child is living with the parent.
