    A BILL FOR AN ACT to amend the Indiana Code concerning motor vehicles.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 9-18-2-48; (05)IN1237.1.1. -->     SECTION 1. IC 9-18-2-48 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2005]: Sec. 48. (a) The commissioner may enter into a contract or an agreement authorizing a person to create and use a reproduction of a license plate issued under this article.
    (b) Except as provided in IC 9-18-12-2.5, a person may not create or use a reproduction of a license plate issued under this article unless the creation or use of the reproduction is expressly authorized in writing by the commissioner. The commissioner may impose under IC 4-21.5 a civil penalty upon a person who violates this subsection. The amount of a civil penalty imposed under this subsection:
        (1) shall be determined by the commissioner; and
        (2) may not exceed ten thousand dollars ($10,000).
    (c) Money paid to the bureau as:
        (1) compensation to the state under a contract or an agreement entered into under subsection (a); or
        (2) a civil penalty imposed under subsection (b);
shall be collected and deposited according to IC 9-29-1-1.
SOURCE: IC 9-18-12-2; (05)IN1237.1.2. -->     SECTION 2. IC 9-18-12-2 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2005]: Sec. 2. (a) The bureau shall issue one (1) license plate to the person who owns an antique motor vehicle that is registered under this chapter.
    (b) A license plate for an antique motor vehicle shall be:
        (1) manufactured of embossed steel; and
        (2) painted a cream color.
    (c) The lettering imprinted on a license plate issued under this chapter shall:
        (1) be painted in red;
        (2) contain:
            (A)
     (b) The bureau shall design the license plate issued under this chapter. The license plate must:
         (1) contain the registration number assigned to the registration certificate by the bureau; and
        (B) (2) include the words "Historic "Collector Motor Vehicle, State of Indiana"; and
        (3) indicate the year for which the antique motor vehicle has been registered.
    (d) (c) Instead of issuing a new license plate each time that an antique motor vehicle is registered, the bureau may issue to the person who owns the antique motor vehicle a tag or sticker that indicates the year for which the motor vehicle has been registered.
    (e) (d) A license plate issued under this chapter shall be securely attached to the rear of an antique motor vehicle.
SOURCE: IC 9-18-12-2.5; (05)IN1237.1.3. -->     SECTION 3. IC 9-18-12-2.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2005]: Sec. 2.5. (a) A person who registers an antique motor vehicle under this chapter may display on the antique motor vehicle a license plate from the model year of the antique motor vehicle instead of a license plate issued under this chapter.
    (b) A model year license plate described in subsection (a) must be:
        (1) an authentic license plate from the model year of the antique motor vehicle; or
        (2) a reproduction of an authentic license plate from the model year of the antique motor vehicle that is identical to the authentic license plate in material, size, form, and color.
    (c) A model year license plate described in subsection (a) may be displayed instead of a license plate issued under this chapter only

while the antique motor vehicle is participating in a:
        (1) parade; or
        (2) procession consisting solely of antique motor vehicles in which the antique motor vehicles are operated on a designated route intended to publicly display the antique motor vehicles.
The current certificate of registration and the license plate issued under this chapter for the antique motor vehicle must be kept in the antique motor vehicle and made available for inspection upon demand by a law enforcement officer. Notwithstanding IC 9-18-2-21, this subsection is not satisfied by keeping a reproduction of the certificate of registration in the vehicle or making a reproduction of the certificate of registration available for inspection.

SOURCE: ; (05)IN1237.1.4. -->     SECTION 4. [EFFECTIVE JULY 1, 2005] Notwithstanding IC 9-18-12-2, as amended by this act, the issuance of:
        (1) an existing historic motor vehicle license plate must occur for an antique motor vehicle registered under IC 9-18-12 before January 1, 2006; and
        (2) a newly designed collector motor vehicle license plate must occur for an antique motor vehicle registered under IC 9-18-12 after December 31, 2005.
