Synopsis: Diversity commissions at state universities. Creates a diversity commission at each state educational institution to: (1) review and approve employment policies concerning diversity; (2) hear faculty and administration personnel complaints concerning diversity; and (3) make recommendations to promote and maintain cultural diversity among faculty members of state educational institutions. Requires the commission to submit a report to the governor and legislative council annually.

    A BILL FOR AN ACT to amend the Indiana Code concerning education.

Be it enacted by the General Assembly of the State of Indiana:

     Chapter 23.5. Indiana University Diversity Commission
    Sec. 1. As used in this chapter, "commission" refers to the Indiana University diversity commission established by section 2 of this chapter.
    Sec. 2. The Indiana University diversity commission is established.
    Sec. 3. The commission shall do the following for Indiana University:
        (1) Review and approve faculty employment policies concerning diversity issues.
        (2) Hear faculty and administration personnel complaints concerning diversity issues.
        (3) Make recommendations to promote and maintain cultural diversity among faculty members.
    Sec. 4. (a) The commission consists of the following seventeen (17) members appointed by the governor:
        (1) Four (4) members of the house of representatives, to be appointed on recommendation of the speaker of the house of representatives. Not more than two (2) members appointed under this subdivision may be members of the same political party. Two (2) members appointed under this subdivision must be members of the Indiana Black Legislative Caucus.
        (2) Four (4) members of the senate, to be appointed on recommendation of the president pro tempore of the senate. Not more than two (2) members appointed under this subdivision may be members of the same political party. Two (2) members appointed under this subdivision must be members of the Indiana Black Legislative Caucus.
        (3) The governor or the governor's designee.
        (4) Four (4) members of the faculty of Indiana University who hold the rank of assistant professor or higher.
        (5) Two (2) members who are alumni of Indiana University.
        (6) Two (2) members who represent organizations whose objectives include promoting cultural diversity.
    (b) Vacancies shall be filled by the governor for the remainder of the unexpired term.
    (c) Each member of the commission serves at the governor's pleasure.
    (d) Each member of the commission who is a member of the general assembly is a nonvoting member.
    Sec. 5. The governor or the governor's designee is the chairperson of the commission.
    Sec. 6. The department of education shall staff the commission.
    Sec. 7. The commission shall meet on call of the chairperson and at other times that the commission determines.
    Sec. 8. Nine (9) members of the commission constitute a quorum. The affirmative votes of at least nine (9) voting members of the commission are required for the commission to take final action, including annual reports.
    Sec. 9. The commission shall issue an annual report stating the findings, conclusions, and recommendations of the commission. The commission shall submit the report to the governor and the legislative council. A report submitted under this section to the legislative council must be in an electronic format under IC 5-14-6.
    Sec. 10. Except as provided in section 13 of this chapter, the expenses of the commission shall be paid from money appropriated

to the department of education.
    Sec. 11. Each member of the commission who is not a state employee is entitled to the minimum salary per diem provided by IC 4-10-11-2.1(b). The member is also entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties as provided in the state policies and procedures established by the Indiana department of administration and approved by the budget agency.
    Sec. 12. Each member of the commission who is a state employee but who is not a member of the general assembly is entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties as provided in the state policies and procedures established by the Indiana department of administration and approved by the budget agency.
    Sec. 13. Each member of the commission who is a member of the general assembly is entitled to receive the same per diem, mileage, and travel allowances paid to legislative members of interim study committees established by the legislative council. Per diem, mileage, and travel allowances paid under this section shall be paid from appropriations made to the legislative council or the legislative services agency.

    Sec. 10. Except as provided in section 13 of this chapter, the expenses of the commission shall be paid from money appropriated to the department of education.
    Sec. 11. Each member of the commission who is not a state employee is entitled to the minimum salary per diem provided by IC 4-10-11-2.1(b). The member is also entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties as provided in the state policies and procedures established by the

Indiana department of administration and approved by the budget agency.
    Sec. 12. Each member of the commission who is a state employee but who is not a member of the general assembly is entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties as provided in the state policies and procedures established by the Indiana department of administration and approved by the budget agency.
    Sec. 13. Each member of the commission who is a member of the general assembly is entitled to receive the same per diem, mileage, and travel allowances paid to legislative members of interim study committees established by the legislative council. Per diem, mileage, and travel allowances paid under this section shall be paid from appropriations made to the legislative council or the legislative services agency.
