A BILL FOR AN ACT to amend the Indiana Code concerning state
offices and administration and to make an appropriation.

SECTION 1. IC 4-23-7.3 IS ADDED TO THE INDIANA CODE
AS A
NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
JULY 1, 2005]:
Chapter 7.3. Geographic Information System
Sec. 1. As used in this chapter, "council" refers to the
geographic information system council established by section 11 of
this chapter.
Sec. 2. As used in this chapter, "executive director" refers to the
executive director of the office of geographic information.
Sec. 3. As used in this chapter, "fund" refers to the GIS
development and maintenance fund established by section 17 of
this chapter.
Sec. 4. As used in this chapter, "GIS" refers to geographic
information systems.
Sec. 5. As used in this chapter, "IGIC" refers to the Indiana
Geographic Information Council, Inc., established as an Indiana
nonprofit corporation on May 16, 2002.
Sec. 6. As used in this chapter, "office" refers to the office of
geographic information established by section 14 of this chapter.
Sec. 7. As used in this chapter, "political subdivision" has the
meaning set forth in IC 36-1-2-13.
Sec. 8. As used in this chapter, "state agency" has the meaning
set forth in IC 4-13-1-1.
Sec. 9. As used in this chapter, "state educational institution"
has the meaning set forth in IC 20-12-0.5-1.
Sec. 10. As used in this chapter, "state library" refers to the
Indiana state library established by IC 4-23-7-3.
Sec. 11. (a) The geographic information system council is
established.
(b) The council consists of the following members:
(1) The lieutenant governor or the lieutenant governor's
designee.
(2) Two (2) individuals appointed by the governor to
represent state agencies.
(3) Two (2) individuals appointed by the governor to
represent commercial GIS service providers.
(4) Two (2) individuals appointed by the governor to
represent the interests of state educational institutions in GIS.
(5) Two (2) individuals appointed by the governor to
represent cities and towns.
(6) Two (2) individuals appointed by the governor to
represent counties.
(7) Two (2) individuals appointed by the IGIC to represent the
IGIC.
(c) A member of the council appointed by the governor serves
at the governor's pleasure.
(d) The lieutenant governor or the lieutenant governor's
designee serves as chair of the council.
(e) Seven (7) voting council members constitute a quorum. The
affirmative votes of at least seven (7) voting council members are
necessary for the council to take official action other than to
adjourn or to meet to hear reports or testimony.
(f) The council shall meet at the call of the chair.
(g) Each member of the council who is not a state employee is
entitled to the following:
(1) The minimum salary per diem provided by
IC 4-10-11-2.1(b).
(2) Reimbursement for traveling expenses as provided under
IC 4-13-1-4 and other expenses actually incurred in
connection with the member's duties as provided in the state
policies and procedures established by the Indiana
department of administration and approved by the budget
agency.
(h) Each member of the council who is a state employee is
entitled to reimbursement for traveling expenses as provided under
IC 4-13-1-4 and other expenses actually incurred in connection
with the member's duties as provided in the state policies and
procedures established by the Indiana department of
administration and approved by the budget agency.
Sec. 12. The council shall do the following:
(1) Oversee the office and the administration of the fund.
(2) Provide policy support and strategic direction to the office.
(3) Cooperate with the United States Board on Geographic
Names established by P.L.80-242 by serving as the state
names authority for Indiana.
Sec. 13. The council's expenses shall be paid from the fund.
Sec. 14. (a) The office of geographic information is established
within the state library.
(b) The governor shall appoint an executive director for the
office.
(c) The executive director serves at the pleasure of the governor.
(d) The executive director serves as the chief executive officer of
the council and the office.
(e) The office shall provide staff and other administrative
support for the council.
Sec. 15. (a) The office shall do the following:
(1) Maintain the following:
(A) A statewide GIS inventory of current and planned
geographic information systems, framework data, and
applications.
(B) Information on grants available for the acquisition or
enhancement of GIS resources.
(C) A directory of GIS resources available in Indiana or
from the federal government.
(2) Provide high level advice and assistance to state and local
government agencies in developing GIS capacity, including
the development and maintenance of multiagency or
multijurisdictional, statewide GIS in cooperation with other
persons.
(3) Advise on data sensitivity issues so that information is
available to the public while protecting needed confidentiality.
(4) Publish a statewide GIS plan and annual report.
(5) Represent Indiana's interests in communications and
discussions with federal agencies regarding spatial data,
spatial data exchanges, cost leveraging opportunities, spatial
data standards, and other GIS related issues.
(b) The office may do the following:
(1) Work with other persons to support the functions of
statewide GIS coordination.
(2) Administer GIS grant programs for political subdivisions
or other persons to establish and maintain GIS as those
programs are established by political subdivisions, the state,
the federal government, state educational institutions, or any
other person.
(3) Coordinate multiagency or multijurisdictional GIS
projects, including the development and maintenance of
statewide framework data layers associated with a statewide
base map (orthophotography, cadastral, transportation,
elevation, surface water, geodetic control, and boundaries).
(4) Maintain multiagency or multijurisdictional data sharing
agreements for framework and other GIS data.
(5) In cooperation with other persons:
(A) evaluate;
(B) participate in pilot studies of; and
(C) make recommendations on;
GIS hardware and software.
(6) Prepare funding proposals for grants to enhance
coordination and implementation of GIS.
(7) Participate in the IGIC.
Sec. 16. The office shall coordinate efforts with Indiana
University, Purdue University, Indiana State University, Ball State
University, and the University of Southern Indiana to do the
following:
(1) Promote formal GIS education opportunities for full-time
and part-time students.
(2) Provide informal GIS learning opportunities through a
series of seminars and noncredit concentrated classes
provided around Indiana.
(3) Coordinate research assets for the benefit of Indiana by
maintaining inventories of the universities' academic and
technical experts, data and technology resources, and
research interests for collaboration to pursue research grant
opportunities.
(4) Implement an outreach network to Indiana political
subdivisions to enhance communication and data sharing
among state government, political subdivisions, and the
business community.
Sec. 17. (a) The GIS development and maintenance fund is
established for the following purposes:
(1) Funding GIS grants.
(2) Administering this article.
(b) The fund consists of the following:
(1) Appropriations made to the fund by the general assembly.
(2) Gifts or grants received by the state for GIS purposes.
(c) Money in the fund is appropriated for the purposes
described in section 15 of this chapter.
(d) The office shall administer the fund.
(e) The expenses of administering the fund shall be paid from
money in the fund.
(f) The treasurer of state shall invest the money in the fund not
currently needed to meet the obligations of the fund in the same
manner as other public money may be invested. Interest that
accrues from these investments shall be deposited in the fund.
(g) Money in the fund at the end of a state fiscal year does not
revert to the state general fund.
