I move that House Bill 1306 be amended to read as follows:
Delete the title and insert the following:
A BILL FOR AN ACT to amend the Indiana Code concerning labor.
SOURCE: IC 22-4-18-8; (06)MO138301.5. --> "SECTION 1. IC 22-4-18-8 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTI9VE JULY 1, 2006] [EFFECTIVE JULY 1, 2006]: (a) Each employer within Indiana shall verify to the department by October 1, 2006, in the manner prescribed by the department, that each employee of the employer is a legal resident of the United States.
(b) Each employer has an ongoing duty to verify to the department within five (5) days of the hire of a new employee, or upon the hire of an employee who formerly had been in the employ of the employer, that the employee is a legal resident of the United States.
(C) An employer that:
(1) fails to notify the department of the verification requirements of subsection (a) or (b); or
(2) falsifies a verification requirement under subsection (a) or (b);
is subject to a civil penalty equal to the total payroll for the employer for the calendar month previous to the violation. Civil
penalties collected under this section shall be deposited in the state general fund.".
Renumber all SECTIONS consecutively.
