MR. SPEAKER:

    I move that House Bill 1349 be amended to read as follows:

SOURCE: ; (06)MO134904.21. -->     "SECTION 21. [EFFECTIVE JULY 1, 2006] (a) As used in this SECTION, "director" refers to the director of the department of natural resources.
    (b) Before July 1, 2007, the director shall adopt rules under IC 4-22-2 to amend 312 IAC 9-10-9 to provide for the following:
        (1) That the rules adopted under this SECTION do not apply to zoological parks (as defined in IC 14-22-26-2), federally licensed wildlife rehabilitation facilities, and university animal clinics.
        (2) That the director may not:
            (A) issue a permit to rehabilitate a wild animal that may be harmful or dangerous to humans or animals; or
            (B) allow a facility for a wild animal that may be harmful or dangerous to humans or animals to be expanded;
        until after notice of the proposed action has been served by the applicant on the landowners adjoining the property where the wild animal will be kept and notice has also been published. The director shall provide an opportunity for a hearing on the permit application in the county where the wild animal will be kept upon request of a resident of the county or a resident who lives within one (1) mile of where the animal will be located.
        (3) The notice provided under subdivision (1) must contain the information and be in the format required by the director.
        (4) That a separate permit is required for the possession for rehabilitation purposes of each wild animal that may be harmful or dangerous to humans or animals.
    (c) This SECTION expires July 1, 2008.
