A BILL FOR AN ACT to amend the Indiana Code concerning state
and local administration.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 5-10-8-14 IS ADDED TO THE INDIANA CODE
AS A
NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2006]:
Sec. 14. (a) As used in this section, "health benefit plan"
means a:
(1) self-insurance program established under section 7(b) of
this chapter to provide group health coverage; or
(2) contract with a prepaid health care delivery plan that is
entered into or renewed under section 7(c) of this chapter.
(b) As used in this section, "heart health program" means a
program of the state department of health that includes evaluation,
referral, and monitoring of individuals to attempt to improve
cardiovascular and pulmonary health of the individuals.
(c) The state shall, before July 1, 2007, allow all state employees
to participate in a heart health program.
(d) The heart health program must include the following:
(1) Evaluation of a state employee's cardiovascular and
pulmonary health, personal fitness, and high risk behaviors.
(2) Identification of state employees who are at high risk for
cardiovascular or pulmonary disease.
(3) Referral of a state employee who is identified as high risk
under subdivision (2) to a physician or case manager to
develop a management plan for the state employee, including
goals and benchmarks for evaluation of progress.
(4) Provision of cardiovascular and pulmonary health
education and programs, including smoking cessation,
nutrition, and exercise.
(5) Encouragement and monitoring of a state employee's
progress.
(e) The state shall annually provide to a state employee who:
(1) participates in; and
(2) achieves the goals developed for the state employee under;
the heart health program a one hundred dollar ($100) reduction in
the state employee's share of the premium for the state employee's
coverage under a health benefit plan.
