Synopsis: Child passenger restraint systems exception. Provides that
the laws relating to the use of passenger restraint systems for children
do not apply to the operator of a motor vehicle used in the following:
(1) A funeral procession. (2) The return trip to the funeral home. (3)
Both the procession and the return trip. Repeals and relocates the
definition of "funeral procession". Makes conforming amendments.
Effective: July 1, 2006.

A BILL FOR AN ACT to amend the Indiana Code concerning

SECTION 1. IC 9-13-2-17 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2006]: Sec. 17. (a) "Bus" means,
except as provided in subsection (b), the following:
(1) A motor vehicle or a passenger carrying semitrailer used for
the purpose of carrying passengers on a regular schedule of time
and rates between fixed termini.
(2) A motor vehicle or a passenger carrying semitrailer designed
for carrying more than ten (10) passengers exclusive of the driver.
The term does not include school buses, or motor vehicles that are
funeral equipment and that are used in the operation of
business. services (as defined in IC 25-15-2-17).
(b) "Bus", for purposes of IC 9-21, means the following:
(1) A motor vehicle designed for carrying passengers for hire and
used for the transportation of persons.
(2) A motor vehicle other than a taxicab designed or used for the
transportation of persons for compensation.

SECTION 2. IC 9-13-2-69.5 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2006]: Sec. 69.5. "Funeral
has the meaning set forth in IC 9-21-13-0.5. means two (2)
or more vehicles, including a lead vehicle or a funeral escort
vehicle, accompanying human remains.

SECTION 3. IC 9-19-11-1 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2006]: Sec. 1. This chapter does not
apply to a person who operates any of the following vehicles:
(1) A school bus.
(2) A taxicab.
(3) An ambulance.
(4) A public passenger bus.
(5) A motor vehicle having a seating capacity greater than nine
(9) individuals that is owned or leased and operated by a religious
or not-for-profit youth organization.
(6) An antique motor vehicle.
(7) A motorcycle.
(8) A motor vehicle that is owned or leased by a governmental
unit and is being used in the performance of official law
(9) A motor vehicle that is being used in an emergency.
(10) A motor vehicle that is funeral equipment used in the
operation of funeral services when used in:
(A) a funeral procession;
(B) the return trip to a funeral home (as defined in
IC 25-15-2-15); or
(C) both the funeral procession and return trip.
