    I move that House Bill 1065 be amended to read as follows:

    Delete the title and insert the following:
    A BILL FOR AN ACT to amend the Indiana Code concerning biofuels.

     Chapter 34. Biofuels Grant Program
    Sec. 1. As used in this chapter, "biodiesel" has the meaning set forth in IC 6-3.1-27-1.
    Sec. 2. As used in this chapter, "biofuel" refers to any of the following:
        (1) Ethanol.
        (2) E85.
        (3) Biodiesel.
        (4) Blended biodiesel.

    Sec. 3. As used in this chapter, "biofuel pump infrastructure" means the following equipment and costs related to dispensing biofuels to consumers for use in motor vehicles:
        (1) Pumps.
        (2) Storage tanks.
        (3) Pipes.
        (4) Fittings.
        (5) Other equipment or costs related to the installation of the equipment described in subdivisions (1) through (4).
    Sec. 4. As used in this chapter, "blended biodiesel" has the meaning set forth in IC 6-3.1-27-2.
    Sec. 5. As used in this chapter, "ethanol" means agriculturally derived ethyl alcohol.
    Sec. 6. As used in this chapter, "E85" has the meaning set forth in IC 6-6-1.1-103(s).
    Sec. 7. As used in this chapter, "fund" refers to the biofuels grant fund established by section 9 of this chapter.
    Sec. 8. As used in this chapter, "motor vehicle" has the meaning set forth in IC 6-6-1.1-103(h).
    Sec. 9. (a) The biofuels grant fund is established within the state treasury to provide money for the development of biofuel pump infrastructure in Indiana.
    (b) The fund consists of:
        (1) appropriations from the general assembly; and
        (2) allocations, grants, or gifts from the federal government.
    (c) The office of the lieutenant governor shall administer the fund. The following may be paid from money in the fund:
        (1) Expenses of administering the fund.
        (2) Nonrecurring administrative expenses incurred to carry out the purposes of this chapter.
    (d) The treasurer of state shall invest the money in the fund not currently needed to meet the obligations of the fund in the same manner as other public funds are invested. Interest that accrues from these investments must be deposited in the state general fund.
    (e) Money in the fund at the end of a state fiscal year does not revert to the state general fund.
    Sec. 10. Subject to the availability of money in the fund, the office of the lieutenant governor may award grants from the fund to applicants seeking financial assistance with the acquisition, modification, retrofitting, or installation of biofuel pump infrastructure in Indiana.

     Sec. 11. (a) An entity that operates or intends to operate a biofuel pump in Indiana in connection with the entity's trade or business may apply for a grant under this chapter.
    (b) To be eligible for a grant under this chapter, an applicant must:
        (1) submit an application in the form prescribed by the office of the lieutenant governor;
        (2) demonstrate that the applicant is acquiring, modifying, retrofitting, or installing biofuel pump infrastructure in Indiana; and
        (3) provide any other information that the office of the lieutenant governor reasonably requires.
