    I move that House Bill 1226 be amended to read as follows:

SOURCE: IC 10-11-2-1.5; (07)MO122604.1. -->     "SECTION 1. IC 10-11-2-1.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2007]: Sec. 1.5. As used in this chapter, "credit card" means a bank card, debit card, charge card, prepaid card, or other similar method of payment.
SOURCE: IC 10-11-2-16.3; (07)MO122604.2. -->     SECTION 2. IC 10-11-2-16.3 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2007]: Sec. 16.3. (a) This section applies to a person holding a driver's license issued under the laws of a jurisdiction other than Indiana.
    (b) If an officer or a police employee of the department issues a citation for a traffic violation under IC 9 or a local ordinance that corresponds to a provision under IC 9 to a person described in subsection (a), the person may immediately pay the officer or police employee the amount of:
        (1) the fine; and
        (2) the court costs;
that apply if the person does not pay the officer or police employee under this section, plus a convenience fee of ten dollars ($10).
    (c) An officer or a police employee of the department shall accept a credit card (as defined in section 1.5 of this chapter) payment for amounts payable under subsection (b). If a person

uses a credit card to make a payment under subsection (b), the officer or police employee shall charge an additional credit card transaction fee that is determined by the department.
    (d) An officer or a police employee of the department shall issue a receipt to a person described in subsection (a) who pays for a violation under this section.
    (e) A convenience fee collected under subsection (b) shall be deposited in the following manner:
        (1) Five dollars ($5) to the motor vehicle highway account fund under IC 8-14-1-3.
        (2) Three dollars ($3) to the fish and wildlife fund under IC 14-22-3.
        (3) One dollar ($1) to the state gaming fund under IC 4-33-13.
        (4) One dollar ($1) to the excise fund under IC 7.1-4-9.

(a) The department shall accept payment by credit card for fines, fees, and court costs collected under section 16.3 of this chapter.
    (b) The department may enter into appropriate agreements with banks or other organizations authorized to do business in Indiana to enable the department to accept payment by credit card.
    (c) The department may recognize net amounts remitted by the bank or other organization as deposit in full of amounts due the department.
    (d) The department may pay any applicable credit card service charge or fee for a credit card payment collected under section 16.3 of this chapter.
