Requires the state police department to establish the registry of methamphetamine manufacturers, a computerized data base of persons convicted of manufacturing methamphetamine. Specifies information that must be included in the registry, and requires information in the registry to be made available on the Internet.

HOUSE BILL No. 1293



    A BILL FOR AN ACT to amend the Indiana Code concerning criminal law and procedure.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 10-13-7; (07)IN1293.1.1. -->     SECTION 1. IC 10-13-7 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2007]:
     Chapter 7. Indiana Registry of Methamphetamine Manufacturers
    Sec. 1. As used in this chapter, "methamphetamine manufacturing offense" means the offense of:
        (1) manufacturing;
        (2) financing the manufacture of;
        (3) delivering; or
        (4) financing the delivery of;
methamphetamine.
    Sec. 2. As used in this chapter, "registry" refers to the Indiana registry of methamphetamine manufacturers established under section 3 of this chapter.
    Sec. 3. The superintendent shall establish the Indiana registry of methamphetamine manufacturers as a program within the

department. The registry consists of a computerized data base of every person convicted in Indiana after June 30, 2007, of a methamphetamine manufacturing offense.
    Sec. 4. The registry must include the following information concerning a person convicted in Indiana after June 30, 2007, of a methamphetamine manufacturing offense:
        (1) The name of the person convicted of a methamphetamine manufacturing offense.
        (2) The date on which the person was convicted of a methamphetamine manufacturing offense.
        (3) The county in which the methamphetamine manufacturing offense occurred.
        (4) The address of the property where the laboratory used to create the methamphetamine is located.
        (5) The statute violated by the person convicted of a methamphetamine manufacturing offense.
        (6) The sentence imposed for the methamphetamine manufacturing offense.
        (7) Whether the person convicted of a methamphetamine manufacturing offense was ordered to pay restitution for the costs of an environmental cleanup under IC 35-48-4-17, if this information is known.
    Sec. 5. The superintendent shall make information contained in the registry available on the Internet.
    Sec. 6. The registry must be updated monthly.
    Sec. 7. The department may adopt guidelines to implement this chapter.

SOURCE: ; (07)IN1293.1.2. -->     SECTION 2. [EFFECTIVE JULY 1, 2007] (a) Notwithstanding IC 10-13-7, as added by this act, the superintendent of the state police department is not required to establish the Indiana registry of methamphetamine manufacturers until January 1, 2008.
    (b) This SECTION expires July 1, 2008.
