Synopsis: Certification of fire sprinkler inspectors. Requires the fire prevention and building safety commission to adopt rules that require an individual who inspects an automatic fire sprinkler system to hold certain certification from the National Institute for Certification in Engineering Technologies. Provides an exception to the requirement of certification for the inspection or servicing by a company of its own fire protection sprinkler systems by its own personnel who have knowledge of the installation, construction, or operation of the systems. Makes conforming amendments.

Effective: Upon passage; July 1, 2007.

    A BILL FOR AN ACT to amend the Indiana Code concerning labor and safety.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 22-12-1-2.7; (07)SB0326.2.1. -->     SECTION 1. IC 22-12-1-2.7 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2007]: Sec. 2.7. (a) "Automatic fire sprinkler system" means an integrated system of underground and overhead piping for fire protection purposes that is designed in accordance with the fire safety laws of the commission.
    (b) The system may include the following:
        (1) A water, gas, or chemical supply, including any of the following:
            (A) A gravity tank.
            (B) A fire pump.
            (C) A reservoir.
            (D) A pressure tank.
            (E) A connection beginning at the supply side of a gate valve located at or near the property line where the pipe or piping system provides water, gas, or chemicals used exclusively for fire protection and related appurtenances

and to standpipes connected to automatic sprinkler systems.
        (2) An aboveground network of specially sized or hydraulically designed piping installed in a building or part of a building to which sprinklers are connected in a systematic pattern.
        (3) A controlling valve and a device for actuating an alarm when the system is in operation.
        (4) Activation of the system by:
            (A) heat from a fire; and
            (B) discharge of water, gas, or chemicals over the fire area.
    (c) The term includes the following:
        (1) Wet pipe systems.
        (2) Dry pipe systems.
        (3) Pre-action systems.
        (4) Deluge systems.
        (5) Combined dry pipe and pre-action systems.
        (6) Antifreeze systems.
        (7) Closed loop systems.
        (8) Systems using gases or chemicals.
        (9) Any other fire suppression system approved by the state fire marshal.

SOURCE: IC 22-14-6; (07)SB0326.2.2. -->     SECTION 2. IC 22-14-6 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2007]:
     Chapter 6. Certification of Automatic Fire Sprinkler Inspectors
    Sec. 1. The commission shall adopt rules under IC 4-22-2 that requires an individual who inspects an automatic fire sprinkler system to be certified as a:
        (1) Level II; or
        (2) Level III;
inspector for the inspection and testing of water based systems by the National Institute for Certification in Engineering Technologies.
    Sec. 2. This chapter shall not apply to the inspection or servicing by a company of its own fire protection sprinkler systems by its own personnel who have knowledge of the installation, construction or operation of the systems.

SOURCE: ; (07)SB0326.2.3. -->     SECTION 3. [EFFECTIVE UPON PASSAGE] (a) Notwithstanding IC 22-14-6-1, as added by this act, the fire prevention and building safety commission shall carry out the duties imposed upon the commission under IC 22-14-6-1, as added

by this act, under interim written guidelines approved by the state fire marshal.
    (b) This SECTION expires on the earlier of the following:
        (1) The date rules are adopted under IC 22-14-6-1, as added by this act.
        (2) December 31, 2008.
