Synopsis: Enhanced 911 and emerging technologies. Provides that in
the event of a dispute concerning a request for a connection to
enhanced wireless 911 systems or equipment leased or otherwise
provided by a person to a public safety answering point (PSAP), the
utility regulatory commission shall determine the terms and conditions
for the connection. Requires the regulatory flexibility committee to
study the revision of the Indiana statute governing enhanced wireless
911 systems to include Internet Protocol enabled services and other
emerging technologies. Requires the committee to report any
recommendations resulting from its study to the legislative council not
later than December 1, 2007.
Effective: Upon passage; July 1, 2007.

A BILL FOR AN ACT to amend the Indiana Code concerning local
government.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 36-8-16.5-41.5 IS ADDED TO THE INDIANA
CODE AS A NEW SECTION TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2007]: Sec. 41.5. In the event of a dispute
concerning a request for a connection
to an enhanced wireless 911:
(1) system; or
(2) equipment;
that is leased or otherwise provided by a person to a PSAP,
the
Indiana utility regulatory commission shall, after notice and
hearing, determine and order the terms and conditions governing
the connection.

SECTION 2. [EFFECTIVE UPON PASSAGE] (a) As used in this
SECTION, "committee" refers to the regulatory flexibility
committee established by IC 8-1-2.6-4.
(b) Not later than November 1, 2007, the committee shall study
the revision of the Indiana statute governing enhanced wireless 911
systems to include Internet Protocol enabled services and other
emerging technologies.
(c) The committee shall prepare a report on the committee's
recommendations, if any, concerning the issue described in
subsection (b) and shall submit the report to the legislative council
in an electronic format under IC 5-14-6 not later than December
1, 2007.
