Synopsis: Shooting ranges and discharging a firearm. Prohibits a local unit of government from imposing a minimum lot size on which a shooting range may be located. Prohibits a local unit of government from regulating the lawful discharge of a firearm, except for: (1) the discharge of a firearm on land, in a building, or on other real property owned or administered by a unit, including a highway or a public highway; or (2) using the unit's planning and zoning powers to regulate the discharge of a firearm within 200 feet of a school.

Effective: Upon passage.

    A BILL FOR AN ACT to amend the Indiana Code concerning local government.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 14-22-31.5-5; (08)IN0029.1.1. -->     SECTION 1. IC 14-22-31.5-5 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 5. (a) Except as specifically prohibited by this chapter, a local unit of government may regulate the location, use, operation, safety, and construction of a shooting range.
     (b) A local unit of government may not impose a minimum lot size on which a shooting range may be located.
SOURCE: IC 36-1-3-8.5; (08)IN0029.1.2. -->     SECTION 2. IC 36-1-3-8.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 8.5. (a) This section does not apply to the local regulation of a shooting range under IC 14-22-31.5.
    (b) Notwithstanding any other provision of this chapter, a unit may not regulate in any manner the lawful discharge of a firearm (as defined in IC 35-47-1-5), except as follows:
        (1) A unit may regulate the discharge of a firearm:
            (A) on land;
            (B) in a building; or
            (C) on other real property;
        owned or administered by a unit, including a highway, street, or road (as defined in IC 8-23-1-23) or a public highway (as defined in IC 8-2.1-17-14).
        (2) A unit may use the unit's planning and zoning powers under IC 36-7-4 to restrict or prohibit the discharge of a firearm within two hundred (200) feet of a school.
