Synopsis: Crossing arms on school buses. Provides that: (1) certain
school buses must be equipped with a school bus crossing arm at the
front of the bus; and (2) if on July 1, 2008, an individual or a school
corporation owns or has contracted for the use of a school bus required
to be equipped with a school bus crossing arm, the individual or school
corporation may continue to use the school bus until July 1, 2013.
Provides that a person who operates a school bus not equipped with a
required school bus crossing arm commits a Class C infraction.
Effective: July 1, 2008.

A BILL FOR AN ACT to amend the Indiana Code concerning

SECTION 1. IC 9-19-13-1, AS AMENDED BY P.L.1-2005,
SECTION 101, IS AMENDED TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2008]: Sec. 1. (a) The state school bus
committee established by IC 20-27-3-1 shall adopt and enforce rules
under IC 4-22-2 not inconsistent with this chapter to govern the design
and operation of all school buses used for the transportation of school
children when owned and operated by a school corporation or privately
owned and operated under contract with an Indiana school corporation.
The rules must by reference be made a part of such a contract with a
school corporation. Each school corporation, officer and employee of
the school corporation, and person employed under contract by a
school district is subject to those rules.
(b) The rules adopted under subsection (a) must include the
requirement that a school bus that is subject to the rules must be
equipped with a school bus crossing arm that meets or exceeds
Society of Automotive Engineers (SAE) standards.

SECTION 2. IC 9-19-13-5 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2008]: Sec. 5. (a) This section does
not apply to a person who owns or operates a vehicle or combination
of vehicles that:
(1) contains parts and accessories; and
(2) is equipped;
as required under regulations of the United States Department of
(b) A person who:
(1) violates section 4(1) of this chapter; or
(2) operates a school bus that:
(A) is not equipped with a school bus crossing arm as
required by rules adopted under section 1 of this chapter;
(B) transports school children, in addition to the penalties
stated in sections 2 and 3 of this chapter;
commits a Class C infraction.

SECTION 3. [EFFECTIVE JULY 1, 2008] (a) As used in this
SECTION, "school bus" has the meaning set forth in IC 20-27-2-8.
(b) As used in this SECTION, "school corporation" has the
meaning set forth in IC 36-1-2-17.
(c) As used in this SECTION, "state school bus committee"
refers to the state school bus committee established by

the state superintendent of public instruction elected under
