Synopsis: Crossing arms on school buses. Provides that: (1) certain school buses must be equipped with a school bus crossing arm at the front of the bus; and (2) if on July 1, 2008, an individual or a school corporation owns or has contracted for the use of a school bus required to be equipped with a school bus crossing arm, the individual or school corporation may continue to use the school bus until July 1, 2013. Provides that a person who operates a school bus not equipped with a required school bus crossing arm commits a Class C infraction.

    A BILL FOR AN ACT to amend the Indiana Code concerning motor vehicles.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 9-19-13-1; (08)IN0167.1.1. -->     SECTION 1. IC 9-19-13-1, AS AMENDED BY P.L.1-2005, SECTION 101, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2008]: Sec. 1. (a) The state school bus committee established by IC 20-27-3-1 shall adopt and enforce rules under IC 4-22-2 not inconsistent with this chapter to govern the design and operation of all school buses used for the transportation of school children when owned and operated by a school corporation or privately owned and operated under contract with an Indiana school corporation. The rules must by reference be made a part of such a contract with a school corporation. Each school corporation, officer and employee of the school corporation, and person employed under contract by a school district is subject to those rules.
     (b) The rules adopted under subsection (a) must include the requirement that a school bus that is subject to the rules must be equipped with a school bus crossing arm that meets or exceeds Society of Automotive Engineers (SAE) standards.

FOLLOWS [EFFECTIVE JULY 1, 2008]: Sec. 5. (a) This section does not apply to a person who owns or operates a vehicle or combination of vehicles that:
        (1) contains parts and accessories; and
        (2) is equipped;
as required under regulations of the United States Department of Transportation.
    (b) A person who:
         (1) violates section 4(1) of this chapter; or
        (2) operates a school bus that:
            (A) is not equipped with a school bus crossing arm as required by rules adopted under section 1 of this chapter; and
            (B) transports school children, in addition to the penalties stated in sections 2 and 3 of this chapter;

commits a Class C infraction.

SOURCE: ; (08)IN0167.1.3. -->     SECTION 3. [EFFECTIVE JULY 1, 2008] (a) As used in this SECTION, "school bus" has the meaning set forth in IC 20-27-2-8.
    (b) As used in this SECTION, "school corporation" has the meaning set forth in IC 36-1-2-17.
    (c) As used in this SECTION, "state school bus committee" refers to the state school bus committee established by IC 20-27-3-1.
    (d) As used in this SECTION, "state superintendent" refers to the state superintendent of public instruction elected under IC 20-19-1-1.
    (e) If on July 1, 2008, an individual or a school corporation:
        (1) owns; or
        (2) has contracted for the use of;
a school bus that is not equipped with a school bus crossing arm as required by rules adopted under IC 9-19-13-1, as amended by this act, the individual or school corporation may continue to use the school bus to transport school children until July 1, 2013.
    (f) This SECTION expires July 1, 2013.
