Synopsis: Grading system for use in food establishment inspections. Requires the state department of health (state department) to establish a statewide grading system to be used by local health departments in the inspection of food establishments. Requires the state department to report to the health finance commission on the state department's progress in establishing and implementing the statewide grading system.

    A BILL FOR AN ACT to amend the Indiana Code concerning health.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 16-42-5-24.5; (08)IN0328.1.1. -->     SECTION 1. IC 16-42-5-24.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2008]: Sec. 24.5. The state department shall adopt rules under IC 4-22-2 to establish and implement a statewide grading system to be used by a local health department in the inspection of a food establishment. The grading system must reflect whether critical violations were found at the food establishment and whether the violations were corrected by the food establishment.
SOURCE: ; (08)IN0328.1.2. -->     SECTION 2. [EFFECTIVE JULY 1, 2008] (a) As used in this SECTION, "commission" refers to the health finance commission established by IC 2-5-23-3.
    (b) Not later than September 1, 2008, the state department of health shall report to the commission on the state department's progress in establishing and implementing a statewide grading system for the inspection of food establishments, as required by IC 16-42-5-24.5, as added by this act.
    (c) This SECTION expires December 31, 2008.
