Synopsis: Electronic health records system. Requires health providers
to, not later than January 1, 2010, use an electronic health records
system that meets certain requirements for purposes of billing and
receipt of claim payment for services rendered by the health provider.

A BILL FOR AN ACT to amend the Indiana Code concerning
health.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 16-21-2-17 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2008]: Sec. 17. (a) A hospital, an ambulatory outpatient surgical
center, an abortion clinic, or a birthing center shall, not later than
January 1, 2010, use an electronic health records system for
purposes of billing and receipt of claim payment for services
rendered by the hospital, ambulatory outpatient surgical center,
abortion clinic, or birthing center.
(b) An electronic health records system required under
subsection (a) must allow for:
(1) the exchange of information between the system and the
claim payment system of each third party to which the
hospital, ambulatory outpatient surgical center, abortion
clinic, or birthing center submits a bill; and
(2) compliance with IC 27-8-5.7 and IC 27-13-36.2.

SECTION 2. IC 16-28-2-11 IS ADDED TO THE INDIANA CODE
AS A

1, 2008]: Sec. 11. (a) A health facility shall, not later than January
1, 2010, use an electronic health records system for purposes of
billing and receipt of claim payment for services rendered by the
health facility.
(b) An electronic health records system required under
subsection (a) must allow for:
(1) the exchange of information between the system and the
claim payment system of each third party to which the health
facility submits a bill; and
(2) compliance with IC 27-8-5.7 and IC 27-13-36.2.

SECTION 3. IC 25-1-9-19.5 IS ADDED TO THE INDIANA CODE
AS A
NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2008]:
Sec. 19.5. (a) A practitioner shall, not later than January
1, 2010, use an electronic health records system for purposes of
billing and receipt of claim payment for services rendered by the
practitioner.
(b) An electronic health records system required under
subsection (a) must allow for:
(1) the exchange of information between the system and the
claim payment system of each third party to which the
practitioner submits a bill; and
(2) compliance with IC 27-8-5.7 and IC 27-13-36.2.
