    A BILL FOR AN ACT to amend the Indiana Code concerning elections.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 13-26-4-1; (09)IN0267.1.1. -->     SECTION 1. IC 13-26-4-1 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2009]: Sec. 1. (a) The board of trustees of a district is the governing body of the district.
     (b) Subject to subsection (c), a board may consist of:
        (1) three (3);
        (2) five (5);
        (3) seven (7);
        (4) nine (9);
        (5) eleven (11); or
        (6) thirteen (13);
trustees.
     (c) After December 31, 2009, each unit (as defined in IC 36-1-2-23) included in the district shall be represented on the board by at least one (1) trustee elected by the voters who reside in the unit. The board may also include trustees representing the district at large elected by the voters who reside in the district. Not later than January 1, 2010, a board established before January 1,

2010, shall adopt a plan to transition to a board that meets the requirements of this subsection not later than January 1, 2014.

SOURCE: IC 13-26-4-2; (09)IN0267.1.2. -->     SECTION 2. IC 13-26-4-2 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2009]: Sec. 2. (a) Before January 1, 2010, an order establishing a district may provide for the board to be elected by the voters in the district from districts or wards or from the district at large.
    (b) After December 31, 2009, an order establishing a district must provide for the board to be elected by voters in the district.
    (c) A trustee of a board established before January 1, 2010, who:
        (1) was appointed before; and
        (2) is serving on;
January 1, 2010, is entitled to complete the term to which the trustee was appointed. The successor to the trustee shall be elected as provided by this chapter.
    (d)
Elections and provisions for filling vacancies must be in accordance with IC 3, with the commissioner or the commissioner's designees performing the functions of the election officials.
    SECTION 3. THE FOLLOWING ARE REPEALED [EFFECTIVE JANUARY 1, 2010]: IC 13-26-4-3; IC 13-26-4-4; IC 13-26-4-5; IC 13-26-4-6.
