HOUSE BILL No. 1313
A BILL FOR AN ACT to amend the Indiana Code concerning
criminal law and procedure.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 35-42-4-14 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2009]: Sec. 14. (a) As used in this section, "offender against
children" has the meaning set forth in section 11(a) of this chapter.
(b) As used in this section, "reside" means to spend more than
three (3) nights in a residence in a thirty (30) day period.
(c) As used in this section, "unrelated child" means a child who
is not a:
(1) descendent of the person or of the person's spouse;
(2) first cousin of the person or of the person's spouse;
(3) nephew or niece of the person or of the person's spouse;
(4) parent or grandparent of the person or of the person's
spouse; or
(5) sibling of the person or of the person's spouse.
(d) An offender against children who resides in a residence in
knowing that an unrelated child also resides in the residence
commits unlawfully residing with a child, a Class D felony.
