MADAM PRESIDENT:
The Senate Committee on Rules and Legislative Procedure, to which was referred Senate Bill No. 4,
has had the same under consideration and begs leave to report the same back to the Senate with the
recommendation that said bill be AMENDED as follows:
Delete the title and insert the following:
A BILL FOR AN ACT to amend the Indiana Code concerning
criminal law and procedure.
Delete everything after the enacting clause and insert the
following:
SECTION 1. IC 10-13-6-13.5 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2009]: Sec. 13.5. If a DNA analysis conducted on a DNA sample
as part of a criminal investigation:
(1) does not establish an exact match between the DNA
sample and the DNA profile of an individual whose DNA
record is stored in the Indiana DNA data base; and
(2) indicates that the DNA sample so closely matches the
DNA profile of an individual whose DNA record is stored in
the data base as to reasonably suggest that the DNA sample
comes from a person who is genetically related to the
individual whose DNA record is stored in the data base;
subject to the CODIS (Combined DNA Index System) guidelines on
the use of a DNA record established by the Federal Bureau of
Investigation, the superintendent may authorize an investigation
of one (1) or more persons who are genetically related to the
individual whose DNA records are stored in the data base.

and when so amended that said bill be reassigned to the Senate Committee on Judiciary.
