A BILL FOR AN ACT to amend the Indiana Code concerning

SECTION 1. IC 13-18-10-1, AS AMENDED BY P.L.81-2009,
SECTION 2, AND AS AMENDED BY P.L.127-2009, SECTION 5, IS
CORRECTED AND AMENDED TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2010]: Sec. 1. (a) Subject to subsection (b),
person may not start:
construction of a confined feeding operation; or
(2) expansion of a confined feeding operation that increases
animal capacity or manure containment capacity, or both;
without obtaining the prior approval of the department.
(b) Notwithstanding subsection (a) or any other law, the
department may not approve after June 30, 2010, and before July
(1) the start of construction of a confined feeding operation;
expansion of a confined feeding operation that
increases animal capacity or manure containment capacity, or
regardless of whether the application for approval was submitted
to the department before July 1, 2010.
