    A BILL FOR AN ACT to amend the Indiana Code concerning education.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 20-33-2-27; (10)IN1327.1.1. -->     SECTION 1. IC 20-33-2-27, AS ADDED BY P.L.1-2005, SECTION 17, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2010]: Sec. 27. (a) It is unlawful for a parent to fail to ensure that the parent's child attends school as required under this chapter.
     (b) It is unlawful for the parent of a child who attends school to knowingly or intentionally fail to report to the child's school:
        (1) that the child will be absent from the school; and
        (2) the reason for the child's absence.
    (c) A report required under subsection (b) must be made to the child's school:
        (1) in person or by telephone; and
        (2) if possible, before the beginning of the school day during which the child will be absent.
    (d) A parent required to report a child's absence from school under subsections (b) and (c):
        (1) must make the report to the child's school each day that the child is absent; or
        (2) if applicable, is required to make the report only on the first day of the child's absence if the parent, on the first day of the child's absence, reports to the school how many days the child will be absent.

    (b) (e) Before proceedings are instituted against a parent for a violation of this section, personal notice of the violation shall be served on the parent by the superintendent or the superintendent's designee:
        (1) having jurisdiction over the public school where the child has legal settlement; or
        (2) of the transferee corporation, if the child has been transferred.
    (c) (f) Personal notice must consist of and take place at the time of the occurrence of one of the following events:
        (1) The date of personal delivery of notice.
        (2) The date of receipt of the notice sent by certified mail.
        (3) The date of leaving notice at the last and usual place of the residence of the parent.
If the violation is not terminated not more than one (1) school day after this notice is given, or if another violation is committed during the notice period, no further notice is necessary. Each day of violation constitutes a separate offense.
