SENATE MOTION


MADAM PRESIDENT:

    I move
that Senate Bill 313 be amended to read as follows:

    Page 1, delete lines 15 through 17, begin a new line block indented and insert:
        " (2) Allow a net metering customer to interconnect a facility that generates electricity through any of the following technologies:
            (A) Organic waste biomass from the following sources:
                (i) Dedicated energy crops and trees.
                (ii) Agricultural food and feed crop residues.
                (iii) Aquatic plants.
                (iv) Animal wastes.
                (v) Other organic waste, including organic waste composted through aerobic or anaerobic digestion systems.
            (B) Solar.
            (C) Geothermal.
            (D) Wind.
            (E) Hydroelectric facilities at dams existing before January 1, 2010.
            (F) Hydrogen produced from a resource or technology described in clauses (A) through (E).

         (3) Provide that a net metering customer is not required to own the generating facility that the net metering customer operates.
        (4) Allow a net metering customer to interconnect to an electric utility's distribution facility a generating system that does not exceed the lesser of:
            (A) the customer's electric load; or
            (B) two (2) megawatts.
        (5) Provide that an electric utility may not limit the aggregate amount of net metering facility nameplate capacity.

         (6) Provide the following for billing purposes:
            (A) Require an electric utility to use a kilowatt hour to kilowatt hour ratio of one to one (1:1) when calculating a credit under clause (B).
            (B) Provide that if the amount of electricity generated during a billing cycle by the net metering customer and delivered to the electric utility exceeds the amount of electricity delivered during the same billing cycle by the electric utility to the net metering customer, the electric utility shall credit the difference between the amounts, measured in kilowatt hours, to the net metering customer in the next billing cycle.
            (C) Provide that any remaining credit determined under clause (B) reverts to the utility:
                (i) on a rolling basis beginning in the billing cycle that occurs twelve (12) months after the billing cycle in which the net metering customer first generates excess kilowatt hours; and
                (ii) when the net metering customer becomes ineligible or otherwise stops participating in the electric utility's net metering tariff.

         (7) Require an electric utility to provide to a net metering customer electric service at rates that are:
            (A) nondiscriminatory; and
            (B) identical to rates provided to a customer other than a net metering customer with respect to structure, components, charges, terms, and choice of tariff.

        (8) Define net metering as a methodology under which electricity that is:
            (A) generated by or on behalf of a net metering customer; and
            (B) delivered to an electric utility's distribution facility;
        may be used to offset electricity provided by the electric utility to the net metering customer during an applicable billing period.

         (9) For purposes of measuring electricity used and generated by a net metering customer, and upon the request of a net metering customer, require an electric utility to aggregate a meter to which the net metering customer's generating facility is physically attached and one (1) or more other meters, subject to the following requirements:
            (A) The additional meter is located on the property of the net metering customer.
            (B) The additional meter is used only to measure electricity consumed by the net metering customer.
            (C) The net metering customer must provide at least thirty (30) days notice of a meter to be included in the aggregation, including:
                (i) identification of the meter; and
                (ii) designation of the rank order of the meter for purposes of determining billing credits.
            (D) All charges applicable to a meter account, other than charges that:
                (i) use kilowatt hours as the billing determinant; and
                (ii) are subject to billing credits;
            must be billed to the net metering customer.
            (E) Provide for assignment of kilowatt hour billing credits to additional meters in rank order.
            (F) Provide that any remaining credit determined under clause (E) reverts to the electric utility:
                (i) on a rolling basis beginning in the billing cycle that occurs twelve (12) months after the billing cycle in which the net metering customer first generates excess kilowatt hours measured on the applicable meter; and
                (ii) when the net metering customer becomes ineligible or otherwise stops participating in the electric utility's net metering tariff.
            (G) Provide that a net metering customer that participates in meter aggregation is not required to have all aggregated meters on the same rate schedule.
