    I move that Engrossed Senate Bill 105 be amended to read as follows:

SOURCE: IC 6-1.1-20.3-7.5; (11)MO010510.9. -->     "SECTION 9. IC 6-1.1-20.3-7.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2011]: Sec. 7.5. (a) If the board designates a political subdivision as a distressed political subdivision under section 6.5 of this chapter, the board shall appoint an emergency manager for the distressed political subdivision. If the distressed political subdivision is a municipality (as defined in IC 36-1-2-11) or a township, the board shall appoint the county executive of the county in which the municipality is located to serve as the emergency manager for the distressed political subdivision, unless the county executive declines the appointment. If a municipality designated as a distressed political subdivision is located in more than one (1) county, the board shall appoint the county executive of the county in which the largest part of the territory of the municipality is located to serve as the emergency manager, unless that county executive declines the appointment. If the county executive of the county in which the largest part of the territory of the municipality is located declines the appointment, the board shall appoint the county executive of the county in which the second largest part of the territory of the municipality is located, unless the county executive of the county in which the second largest part of the municipality is located declines the appointment.
    (b) An emergency manager serves at the pleasure of the board.
    (c) The chairperson of the board shall appoint a subcommittee to oversee the activities of an emergency manager.

     (d) This subsection applies to an emergency manager that is not a county executive. The distressed political subdivision for which an emergency manager is appointed under this section shall pay the emergency manager's compensation and reimburse the emergency manager for actual and necessary expenses.".
