Synopsis: Compression release engine brakes. Provides that a person
who drives a motor vehicle (vehicle) equipped with a compression
release engine brake (brake) may not use the vehicle's brake unless the
vehicle is equipped with a factory installed muffler or an equivalent
after market muffler, except in Porter County where brake operation is
prohibited unless there is a failure of the service brake system.
Effective: July 1, 2011.

HOUSE BILL No. 1099
A BILL FOR AN ACT to amend the Indiana Code concerning
motor vehicles.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 9-21-8-44.5 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2011]: Sec. 44.5. (a) As used in this
section, "compression release engine brake" means a hydraulically
operated device that converts a power producing diesel engine into a
power absorbing retarding mechanism.
(b) A person who drives a motor vehicle equipped with compression
release engine brakes on the Indiana toll road in a county having a
population of more than one hundred forty-five thousand (145,000) but
less than one hundred forty-eight thousand (148,000) may not use the
motor vehicle's compression release engine brakes instead of the
service brake system, except in the case of failure of the service brake
system.
(c) Except as provided in subsection (b), a person who drives a
motor vehicle equipped with compression release engine brakes
may not use the motor vehicle's compression release engine brakes
instead of the service brake system unless the motor vehicle is
equipped with a factory installed muffler or an equivalent after
market muffler.
