Synopsis: Manure storage structures. Prohibits a person from starting construction of an earthen or a concrete manure storage structure designed to hold at least 1,000,000 gallons of liquid manure generated by a regulated confined feeding operation without obtaining the prior approval of the department of environmental management.

Effective: July 1, 2011.

HOUSE BILL No. 1187



    A BILL FOR AN ACT to amend the Indiana Code concerning environmental law.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 13-11-2-125.5; (11)IN1187.1.1. -->     SECTION 1. IC 13-11-2-125.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2011]: Sec. 125.5. "Manure", for purposes of section 125.6 of this chapter and IC 13-18-10-1.3, includes the following:
        (1) Animal feces or animal urine, or both.
        (2) Materials that are commingled with animal feces or animal urine, or both, including the following:
            (A) Bedding.
            (B) Litter.
            (C) Liquids.
            (D) Compost.
            (E) Any other material commingled with animal feces or animal urine, or both.

structure", for purposes of IC 13-18-10-1.3, means:
        (1) a pad;
        (2) a pit;
        (3) a pond;
        (4) a lagoon;
        (5) a tank; or
        (6) another containment area;
used to store or treat manure.
    (b) The term includes any part of a building or other structure used specifically to store or treat manure.

SOURCE: IC 13-18-10-1.3; (11)IN1187.1.3. -->     SECTION 3. IC 13-18-10-1.3 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2011]: Sec. 1.3. (a) A person may not start construction of an earthen or a concrete manure storage structure:
        (1) at:
            (A) a confined feeding operation regulated under this chapter; or
            (B) any other location; and
        (2) designed to hold at least one million (1,000,000) gallons of liquid manure generated by a confined feeding operation regulated under this chapter;
without obtaining the prior approval of the department.
    (b) The:
        (1) board shall adopt rules under IC 4-22-2 and IC 13-14-9; and
        (2) department may adopt policies or statements under IC 13-14-1-11.5;
that are necessary to implement this section.
