SENATE MOTION


MADAM PRESIDENT:

    I move
that Senate Bill 112 be amended to read as follows:

SOURCE: IC 7.1-5-9-17; (11)MO011209.8. -->     "SECTION 8. IC 7.1-5-9-17 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2011]: Sec. 17. (a) As used in this section, "beer and liquor wholesaler" means a person who holds a beer wholesaler's permit under IC 7.1-3-3 and a liquor wholesaler's permit under IC 7.1-3-8.
    (b) Notwithstanding any other law, if the commission finds that the granting of a beer and liquor wholesaler permit under this chapter results in the displacement of any employee of an existing beer wholesaler, the commission shall require the beer and liquor wholesaler to pay each displaced employee an amount equivalent to the unemployment benefit the displaced employee would otherwise be entitled to receive under IC 22-4.
    (c) Notwithstanding any other law, if the commission finds that the granting of a beer and liquor wholesaler permit under this chapter results in the displacement of any employee of an existing beer wholesaler, the commission shall require the beer and liquor wholesaler to pay the cost necessary for the displaced employee to participate in the healthy Indiana check-up plan under IC 12-15-44.2.
    (d) Notwithstanding any other law, if the commission finds that the granting of a beer and liquor wholesaler permit under this chapter results in the closing of an existing beer wholesaler, the commission shall require the beer and liquor wholesaler to pay to the each political subdivision (as defined in IC 3-5-2-38) an amount
equivalent to the amount of taxes lost to the political subdivisions as a result of the closing of the existing beer wholesaler.
