MR. SPEAKER:

    I move that Engrossed Senate Bill 286 be amended to read as follows:

SOURCE: Page 38, line 21; (12)MO028630.38. -->     Page 38, between lines 21 and 22, begin a new paragraph and insert:
    " (e) If a local child fatality team reviews the death of a child who:
        (1) was a child in need of services;
        (2) resided in a foster care home or group home funded by the department;
        (3) had been the subject of an investigation by the department; or
        (4) had received services from the department;
the local child fatality review team shall report its findings concerning the child's death to the department before the first day of the month following the month in which the local child fatality review team makes its findings.

     (f) Not more than twenty-four (24) hours after receiving a report under subsection (e) or IC 31-33-25-10(d), the department shall:
        (1) issue a public release detailing the nature and circumstances of each fatality covered by the report; and
        (2) post the information described in subdivision (1) on the Indiana transparency Internet web site.

subsection (b), meetings of the statewide child fatality review committee are open to the public.
    (b) Except as provided in subsection (d), A meeting of the statewide child fatality review committee that involves:
        (1) confidential records; or
        (2) identifying information regarding the death of a child that is confidential under state or federal law;
shall be held as an executive session.
    (c) If a meeting is held as an executive session under subsection (b), each individual who:
        (1) attends the meeting; and
        (2) is not a member of the statewide child fatality review committee;
shall sign a confidentiality statement prepared by the department. The statewide child fatality review committee shall keep all confidentiality statements signed under this subsection.
    (d) A majority of the members of the statewide child fatality review committee may vote to disclose any report or part of a report regarding a fatality review to the public if the information is in the general public interest as determined by the statewide child fatality review committee.
     (d) If the statewide child fatality review committee reviews the death of a child who:
        (1) was a child in need of services;
        (2) resided in a foster care home or group home funded by the department;
        (3) had been the subject of an investigation by the department; or
        (4) had received services from the department;
the statewide child fatality review committee shall report its findings concerning the child's death to the department before the first day of the month following the month in which the statewide child fatality review committee makes its findings.
".
