"SECTION 22. [EFFECTIVE UPON PASSAGE] (a) On May 1,
2013, a rule adopted by the state board of education in January
2012, concerning the grading of Indiana's public schools and school
districts is void.
(b) Beginning March 1, 2012, the state board of education shall
begin the process of developing a new proposal to address the
grading of Indiana's public schools and school districts under this
SECTION so long as the proposal complies with the following:
(1) The proposal may not employ a methodology that permits
grading on a curve (also known as curved grading or grading
on a bell curve) or any other statistical method of assigning
grades designed to yield a predetermined distribution of
grades among schools or school districts.
(2) The proposal may not use raw student assessment results
for more than fifty percent (50%) of the grade.
(3) The proposal must use as a majority component the
improvement growth of the school or school district from one
(1) year to the next.
(4) The proposal may use other performance components for
the balance of the grading.
(5) The state board of education must convene al least three
(3) regional public hearings on the proposal at which
interested parties may offer input and recommendations
regarding the proposal.
(6) Before the proposal may go into effect, the proposal must
come before the general assembly in the 2013 regular session
in the form of an introduced bill to be considered by the
general assembly for enactment.
(c) Upon enactment of legislation by the general assembly under
subsection (b)(6), the state superintendent of public instruction
shall inform the United States Department of Education of the
enactment of the legislation.".
